Antitrust Rules

The development of the modern market, high competition among its participants allows to improve antimonopoly conditions and rules, the order of takeover or merger of business entities, unfair competition between competitors and control over their activities - this is not a complete list of issues arising in the course of the company's work.

What AMCU controls

These are:

• Issues related to violations of norms and provisions of antimonopoly legislation.
• Development and implementation of recommendations, as well as clarifications of AMCU regarding the compliance of work with the norms of antimonopoly legislation.
• Preliminary decision in the matter of obtaining authorization for approval of certain actions, concentration and possibility of refusal to grant such authorization.
• Submission/rejection of authorization for certain approvals of actions, concentration.
• Appeals against public procurements.

Violations of antitrust rules

With regard to violations of the provisions of antitrust rules and provisions of the law - most often said about these:

• Anticompetitive harmonization of actions that restrict certain actions, committing illegal acts.
• Abuse of own monopolistic, superior position.
• Anticompetitive decisions and actions of executive and legislative authorities, subjects of the economic market.
• Non-fulfillment or incomplete fulfillment of AMCU decisions or unlawful actions by the parties to the agreement.
• Delegation of official powers to third parties by authorities or individual representatives of authorities in cases directly prohibited by the law.
• Discriminatory and restrictive activities on the part of market participants.
• Violation of norms and provisions agreed with AMCU of the provisions of constituent, authorizing documents, which, as a result, restricts competition.
• Illegal competition conducted without authorization of AMCU bodies.

This includes the failure of business entities, market participants to submit data within the established deadlines, or submission of inaccurate or incomplete data.

The following issues and provisions from the sphere of authority can also be included in this list:

1. Obstruction of AMCU representatives in conducting legal inspections by the latter, seizure of property.
2. Submission of recommendations to authorities and other competent persons, bodies, which induce to violation of provisions and norms of the law or which will contribute to such violation.
3. Non-fulfillment by all market participants of the provisions of the adopted agreements, the requirements, which condition them, other norms and rules.
