Temporary protection in Germany for Ukrainians has been extended: the EU prolonged protection to 04.03.2028 (Decision 2026/1912), and on 30.09.2026 Germany amended its transitional ordinance — people arriving from Ukraine by 04.12.2027 may stay 90 days without a residence permit and apply under Section 24 AufenthG, and the ordinance runs to 04.03.2028. Existing Section 24 cards valid on 01.02.2026 were extended automatically to 04.03.2027. For new applicants the EU added a condition to prove compliance with Ukrainian military registration. Checked against the ordinances on 09.10.2026.

As of 09.10.2026, no ordinance extending existing cards automatically to 2028 has been published. Validity after 04.03.2027 will depend on such an act or on an individual extension at the foreigners' authority.

What Section 24 gives and its limits

  • A permit for the duration of protection set by the EU decision (Section 24(1)).
  • Distribution among the federal states: the Federal Office for Migration allocates people to states, and residence follows the allocation decision (Section 24(3)–(5)).
  • New applicants after Decision 2026/1912 prove compliance with Ukrainian military registration duties. People who already had protection on 30.07.2026 and keep it in the same country are not affected.
  • Naturalisation is unavailable on a Section 24 permit, and so is EU long-term resident status.

Switching from Section 24 to a long-term permit

The transitional ordinance expressly allows people who arrived from Ukraine to obtain the required permit inside Germany (Section 3 UkraineAufenthÜV). This matters because Ukrainian citizens are not on the Section 41 AufenthV list and would otherwise apply for a D visa from abroad.

The Opportunity Card (Chancenkarte) cannot be obtained from Section 24 inside Germany: in the country it is issued only to holders of study or employment permits (Section 20a(4)).
