Liquidation of a budgetary organization in Ukraine is not such a common phenomenon, which nevertheless happens in practice. Liquidation procedure in this case - a complex process that requires coordination with state authorities or territorial communities, deregistration in the tax inspection, social insurance, Pension Fund, inventory of property.

Features of the liquidation of the budget organization

According to the norms of the current Budget Code, budgetary organization (BO) - is the bodies of state power, local self-government, as well as organizations that are created by them and financed from the state or local budget.

These include, in particular:

• educational institutions;
• polyclinics, hospitals, state and communal sanatoriums;
• archival institutions;
• houses, palaces of culture and arts;
• museums, libraries;
• state-owned television and radio broadcasting organizations;
• fire protection units of the Ministry of Emergency Situations;
• research institutes;
• natural reserve fund institutions.

That is, the founders of such organizations are either the state or local self-government bodies.

In accordance with the Economic Code, termination of the activities of the BO, a branch of a budgetary organization is possible by:

• liquidation (by decision of the founders or the court);
• reorganization (transformation, division, merger, consolidation).

Most often the decision on liquidation of a budget-funded institution is made by the body, to whose sphere of management this or that organization belongs.

Procedure for liquidation of budgetary institutions

1. Adoption of the decision, drawing up an order on the termination of activities.
2. Notification of the state registrar of the intention to liquidate, entering data on the beginning of the liquidation procedure in the Unified State Register.
3. Creation of a liquidation commission. In the case of the BO, this function can be performed directly by a state or municipal body.
4. Publication of the liquidation of the institution in the media, notification of creditors.
5. Submission of an application to the state registrar.
6. Drawing up an interim liquidation balance sheet.
7. Inventory of property.
8. Settlements with creditors and debtors.
9. Dismissal of personnel, making settlements for work.
10. Deregistration in the Pension Fund, social insurance, State Fiscal Service (as a taxpayer and as a VAT payer).
11. Closing of accounts in the Treasury Service.
12. Approval of the final liquidation balance sheet.
13. Entering data on the liquidation of the budgetary institution in the Unified Register.
