What does the law say about the liquidation of trade unions?

The order of liquidation of a legal entity is established by Art. 104-112 of the Civil Code of Ukraine (hereinafter Civil Code), the Law of Ukraine "On state registration of legal entities and physical persons - entrepreneurs" (p. IV) from 15.05.2003, ¹755-IV (hereinafter Law ¹755-IV) and other regulations.

In practice, most often the primary organizations of trade unions cease their activities in case of liquidation or reorganization, less often bankruptcy of the enterprise.

For reference. Liquidation, reorganization of enterprises, entailing a reduction in the number or staff of employees, can be carried out only after the employer provides information on this issue to trade unions in advance, no later than three months before the upcoming liquidation or reorganization of the enterprise (Article 49-4 of the CLLU, paragraph 3 of Article 22 of the Law of Ukraine "On Trade Unions, their rights and guarantees of activity. If the liquidation of the company is inevitable, do not postpone the decision, and notify employees in advance, as required by law. Otherwise, the company could be sued and the penalties could be severe.
