Commercial disputes in Ukrainian courts

A commercial dispute between business entities is heard by the commercial courts of Ukraine. How it ends depends largely on the primary documents — the contract, the acts, the invoices and the correspondence — and on the legal position built before the claim is filed. Money claims

The largest group of cases concerns payment: recovery of debt under commercial contracts, debt collection, compensation of losses and recovery of a penalty, and disputes on compensation for damages, where the loss may follow from lawful as well as unlawful acts and from contractual as well as non-contractual obligations.

Contracts and property

Disputes about the contract itself are covered by settlement of disputes arising from contractual relations, disputes on changing or terminating a contract and invalidation of commercial contracts, where cases are most often lost because the claim is not proved, the method of protection is chosen incorrectly or powers were exceeded. Property questions are dealt with in recognition of ownership in court and release of accounts and property from seizure.

Procedural documents

Each stage has its own document, and the court examines its form, the jurisdiction and the legal position: a statement of claim or a response, a counterclaim and a cassation appeal when the decision of the first instance and the appeal has to be reviewed further. Copyright protection and other disputes within the competence of the commercial courts complete the section.
