Permanent residence in Germany

German permanent residence is the unlimited settlement permit (Niederlassungserlaubnis) under Section 9 AufenthG. The general rule in 2026: 5 years with a residence permit, secured income, 60 months of mandatory or voluntary pension contributions, sufficient German, basic knowledge of the legal and social order, and housing for the family. Shorter routes exist for EU Blue Card holders (27 months, or 21 months with German at B1), skilled workers (3 years), entrepreneurs under Section 21 (3 years) and spouses of German citizens (3 years). What Section 9 requires

  • 5 years holding a residence permit (Aufenthaltserlaubnis).
  • Secured livelihood for you and your family without social benefits.
  • 60 months of contributions to the statutory pension scheme or comparable private provision; childcare and home-care periods count.
  • Work permission and professional licences where you are employed or in a regulated profession.
  • Sufficient German and civic knowledge, proven by a completed integration course.
  • Housing for you and the family members living with you.
  • No public-security grounds against the permit.

Settlement permit or EU long-term resident status

Both are unlimited, and the law treats them as equal (Section 9a(1)). EU long-term resident status (Erlaubnis zum Daueraufenthalt – EU) also eases moving to another EU country under Directive 2003/109/EC. Holders of permits from Chapter 5 of the AufenthG, including temporary protection under Section 24, cannot obtain it (Section 9a(3)). Which status suits you depends on your plans for mobility within the EU.

Permanent residence for Ukrainians under temporary protection

A Section 24 permit belongs to humanitarian Chapter 5 of the AufenthG. For holders of these permits, Section 26(4) allows a settlement permit once the Section 9(2) conditions are met: 5 years, 60 months of contributions, language, income and housing. The rule is discretionary and the authority decides. For people working in their profession we therefore often consider switching to a Blue Card or a skilled worker permit, where the timelines are shorter and written into the law. Permanent residence and citizenship are separate decisions. Permanent residence gives an unlimited right to live and work in Germany. Citizenship can follow after 5 years of lawful residence on its own conditions; see German citizenship.
