Business immigration to the USA: requirements

To obtain a residence permit you must:

There are several programs: L1, E2, EB5. All of them give the right to settle in the States together with spouses and children up to 21 years of age.

L1 visa

Business emigration program to the United States is suitable for directors and managers of companies. The grounds for application include:

• opening a branch office, representative office;
• confirmation of business activity in the state;
• official employment of three employees during the first year of employment;
• experience in a management position for 1 year or more;
• confirmation of financial turnover between the branch and the head office.

The application is considered for 15 days, in the future it is possible to obtain a visa EB1C (more advanced version of L1, successful business, fame, large turnover) or EB5 and subsequently a green card. The effectiveness of the representative office should be confirmed annually. The residence permit is issued for one year without residency status with the possibility of renewal.

E2 visa

Doing business in the U.S. for Ukrainians is possible by opening a small business. For this purpose, the states must have a corresponding agreement with the country of citizenship of the entrepreneur, and it is necessary to fulfill other conditions:

• the manager is an investor, the founded company is his only place of work;
• the income ensures the applicant's residence in the country;
• finances come only from legal sources.

The E2 visa is valid for up to 2 years and does not entitle the applicant to apply for a Green Card.

EB5 visa

The program of obtaining citizenship through investments has existed in the U.S. for 30 years. EB-5 visa is for those who want to invest in the USA, get a green card and become a resident of this country. But that is not all! You can live and work in the U.S. with your spouse and unmarried children if they are under 21 years of age. This age is considered the age of majority in the States. You will have a great opportunity to give your children a decent education and better health care. In the US, you will be able to have a completely different, more decent, standard of living.

What do I need to get a visa?

It is necessary to invest money in a commercial company in the USA (about 1 million dollars, but it all depends on the location: so, in rural areas, in areas with high unemployment you need to invest $900,000, and in developed places the amount of investment can exceed 1.8 million (up to 2.2 million, for some projects). After 5-7 years, the capital can be returned. You must create a minimum of 10 jobs for 2 years.

At the end of November 2019, the minimum investment amount was increased to $900,000. In 2020, the processing of visa applications was accelerated.

An application for the program can be processed for up to 2 years, but this is the maximum. Under the terms of the program, you will get visa-free access to more than 180 countries around the world. After 5 years, your children and spouse, whom you have the right to bring with you (up to 10 family members in total), will be eligible for citizenship. Permanent residency in America is not required.

Children and spouse are immediately included in the application, they do not need to wait 7 years before receiving a green card.
