Registration of non-profit and public organisations

This section covers the organisational forms that are created for a shared purpose rather than for profit. Legal Solutions drafts the charter and the minutes of the founding meeting, prepares the applications, files the documents with the registrar and obtains the entry in the register of non-profit institutions where the form allows it.

Owners of flats in a block of flats use an association of joint owners of an apartment house or a condominium to manage the building, its common property and the contracts with utilities. A religious community is registered as a religious organisation with a charter that matches the statutory requirements for such societies.

Membership organisations

Ukrainian law recognises several membership-based forms, and each one has its own founding procedure, its own minimum number of founders and its own registration body. The section includes a trade union and an association of trade unions, an organisation of employers, a youth organisation, an organisation of people with disabilities and a political party. Companies that unite their resources register an association of enterprises.

What the work includes

A lawyer checks the proposed name, prepares the charter and the internal documents, describes the governing bodies and the rules for admitting and excluding members, and collects the identification documents of the founders. After the entry in the register, the organisation is put on the tax register and, where it applies, added to the register of non-profit institutions. Changes made later — a new head, a new address, a new charter — are handled in registration of changes in non-profit organisations.

The fee is marked «Individual», because it depends on the documents, the founders and the scope of work; the deadline shown for the majority of services is three working days. The scope, the fee and the schedule are fixed in the contract before the work starts.
