Intellectual property law

Intellectual property is the part of a business that is easiest to copy and hardest to recover once it has been taken: a brand, a text, a piece of software, a design, a database. Ukrainian law protects these objects, and the protection works when the rights are documented before a conflict appears. Legal Solutions advises rights holders on both sides of that work — securing the rights, and defending them.

Securing the rights

The first question is who owns the result: the author, the employer or the customer. The answer is written into the documents — employment documents, an author’s order contract, a contract with a contractor, the terms on which a product is licensed. Contract development covers those documents, and terms and conditions of use covers the rules published by a website or an online service for its users.

Defending the rights

Where an object is used without permission, the matter is taken up in copyright protection, which deals with literary and musical works, software and other objects, and in protection of intellectual property within civil-law disputes. How the work starts

A lawyer examines the documents that confirm the rights, establishes how the object was created and transferred, and assesses what evidence of the infringement exists. On that basis the options are set out: a demand to the infringer, a complaint to the platform on which the material is published, or a claim to the court. The scope of the work, the fee and the agreed deadlines are fixed in the contract before the start.
