Collection of debts through private executors

Since 2016, the Law has been in force in Ukraine, according to which the enforcement of court judgements and decisions of other bodies in Ukraine, along with the state authorities, may be carried out by private enforcement officers, who act within the framework of the Law "On Enforcement Proceedings".

In many cases, recourse to private enforcement officers has a number of advantages over the state enforcement service. Such specialists:

• are more competent, the requirements for them are much higher than for state executors;
• are under strict control of the Ministry of Justice;
• are interested in a favourable outcome of the case, their earnings are 10% of the amount of the recovered debt, while state executors work for a fixed salary plus bonuses;
• are chosen at the customer's request.

Who are private executors and what functions they fulfil

Private executors are persons who have the right to carry out compulsory execution:

• court judgements in civil, administrative, economic cases, letters and orders of the court;
• notary's executive inscriptions;
• decisions of other state bodies and the National Bank.

Unlike collectors, private executors do not "beat out" money by threats, without the presence of legal orders, act solely on the basis of court decisions and may be deprived of the right to carry out activities in case of violations.

A private executor in Ukraine may be a citizen:

• 25 years of age or older;
• who has received a higher legal education, worked for 2 years in the field of jurisprudence and completed at least one month of internship in the state
• executive service;
• without a criminal record;
• who has passed the examination of the Ministry of Justice;
• working in a specially equipped office room (safe, fire alarm system, bars on the windows).

According to the Law on Enforcement Proceedings, the competence of private enforcement officers does not include the collection of debts from:

• The National Bank, state bodies, local authorities, public utilities;
• legal entities whose property realisation is prohibited by law;
• children, incapacitated, limited capacity persons.

In addition, they may not deal with cases in which decisions on the eviction and eviction of individuals or confiscation of property have been made.

Private executors may work only in a certain region. Exception - if the debtor has assets outside the region, and the issue must be resolved within one proceeding.

What services are provided by private executors

1. Recovery of money: debt recovery, payment of wage arrears, loan repayment.
2. Recovery of property: real estate, mortgaged property.
3. Arrest of property (real estate, car) and bank accounts.
4. Sale of debt to a third party.
5. Restriction of the debtor's rights to travel outside the country.
